copies of original fashion design – “seat” or “affordable interpretation,” depending on your point of view – is a practice that designers may have grudgingly accepted in the past, when less expensive copies took some time to reach shops and consumers only one who can afford the original designer of the brand could be the first to follow a trend. This practice is much more advanced technology designer, you can see the high-quality copies appear in stores before the original has even hit the market. Although the practice has long been the fashion industry to bring down American European models, American designers did not copy each other. They registered their original sketches with a trade group originally called Fashion Guild, an organization that urged retailers to prohibit the styles known to be imitations.
In 1941, the Supreme Court ruled that the Guild is an unreasonable restriction of trade, the end of the Guild marked the beginning of knocking off “free-for-all that we know today began. And ‘now common for imitators photographing the clothes of a fashion designer, send the image to be copied in a factory, and “Have a sample ready in a few days for retail buyers to order. Since fashion collections are displayed in runway shows approximately four to five months before they are available to the public, which leaves plenty of time follower of fashion stores copies of the same time, if not earlier than the original. The designers claim that design piracy cuts into their longstanding franchise units by reducing the volume sales, and ultimately remove the incentives for creativity.
Sometimes, the same stores that carry the highest price for selling knockoff version of a garment also cheap, often in private label store. Knocking-off is widespread in the world of fashion and designer who also smoke on the copy does not do make themselves. Because of the speed at which designs can be recreated, nor is it always clear which designer created the original designer simply copied. This debate will focus on how the protection of works of single-mode or does not fit within the current framework of intellectual property rights in the United States. The overall organization of this discussion is a systematic examination of possible protection for works of fashion under copyright, patent and trade dress law. This discussion will cover not only the current state of law, but also proposals for reform, as an amendment to the law on right to protect the works of fashion.
The central question is whether fashion is art worthy of protection or a unit that professionals can freely copy one another. In an industry where many designers come out with similar looks each season – and where inspiration is said to be in the air “- designers and the thriving knockoff industry are fiercely debating the issue.

Another key question: If imitation actually benefit the industry as a whole. Copy, according to some, pushing forward the cycle of fashion by creating popular trends that encourage designers to take the next big idea. In what is called the paradox of “piracy” law professors Kal Raustiala University of California, Los Angeles, and Christopher Sprigman of the University of Virginia argue that copying is wet market trends quickly, driving fashion connoisseurs in search new look. “If the copy is illegal, the fashion cycle occurs very slowly, if at all,” While admit copying can harm individual designers, they say, Congress should protect industries only when piracy stymies – rather than encourages – innovation.
Despite the apparent inadequacy of protection of copyright works in fashion, commentators are often confused with abnormalities of copyright under which fashion accessories, works of architecture and design chips are suitable for the protection of the right copyright. Some argue that copyright has been extended to protect the aforementioned items, copyright may be the best legal tool for fashion designers have when fighting piracy of design.
For example, Robert Denicolò argued that it would be more consistent with the legal principles of intellectual property law to draw the line of copyright in respect of the doubt “useful articles” by shaping whether an item is created in the process, the designer focused primarily on aesthetic or utilitarian. This test is largely Improve the likelihood that the works of fashion would be granted copyright, as most fashion designers are concerned with aesthetics rather than the functional aspects of their clothes.
The specific extension of copyright to fashion works would have many advantages for designers. First, the owner of copyright may seek compensation by way of injunction to prevent the imitator of its production design and copies of the original sale. Second, copyright release and may require counterfeit goods. Thirdly, the copyright owner can recover damages, whether actual or statutory benefits, as well. Finally, the owner of copyright may be able to recover court costs and attorneys fees. This remedy is particularly important in the case of fashion design, because it allows small new designers to take on big manufacturers Whose more powers and financial resources would otherwise be an irreducible obstacle.
Despite these advantages for designers, an amendment to the law on copyright for works of fashion should not be adopted soon. As one commentator succinctly stated that the current situation of legislators and judges have difficulty seeing beyond the utilitarian function of clothing. While industrial designs have been repeated bills, Congress has explicitly excluded fashion works of these bills. For example, when designing anti-piracy Act of 1989 would have protected original designs of useful articles against unauthorized copying, the bill banned clothing designs made up of three-dimensional shapes and surfaces with respect to clothing. According to one commentator, this exclusion has no basis in principle perceptible. E ‘was added to help even the vehement opposition of retailers to the bill. “In this climate of hostility judicial and legislative protection of copyright, will probably not be extended to protect especially the works of fashion.
Fashion seems to be a particularly ill-suited to legal restrictions against copying. The copy or borrowing “or” reinterpret “has spread to all levels of the fashion world. When a low-cost designer designer hits a higher price, the copy can be a great success because it offers more value for money. But is the most expensive designers are copying each other.
Fashion designers work on their finished products as a creator or inventor. It takes hours of careful effort until a dress with just a straight cut or a bag with the perfect design is complete. Why is this hard work and effort not to the person behind the level of security, allowing them to reap the benefits of their work?
As a matter of public policy, it is generally accepted that the imitators are good for the economy. The request of copyright claims that prevention mode eliminates the possibility of a monopoly in providing consumers with lower prices imitations. It ‘also argued that imitation really promote business for the designer in creating a market for a fashionable style. But we really believe this? And what’s wrong with having a monopoly on fashion? When a consumer spends thousands of dollars in a bag or a dress that others recognize as Louis Vuitton or Versace, they should be able to enjoy the exclusivity that comes with this purchase. Knockoffs rob consumers of their exclusive right to enjoy a specific product.
There are policy issues behind the strength of the government to Provide a copyright for fashion, ranging aversion to the creation of monopolies for the improvement of the market.
If the designer believes another person infringed his copyright, he could sue those who sell or manufacture the design in a federal court. Those found guilty face fines of 250,000 or $ 5 per copy, whichever is greater. P>
